Terms of Service

1. Service Provider

Yummoria is operated by Mateusz Dabrowski IT, a sole proprietorship registered under CEIDG (Centralna Ewidencja i Informacja o Dzialalnosci Gospodarczej) in Poland.

2. Acceptance of Terms

By creating an account or using Yummoria, you agree to these Terms of Service and our Privacy Policy. If you do not agree, you may not use the service. You must be at least 16 years old to use Yummoria.

Yummoria is a recipe management and meal planning platform. The service includes:

You are responsible for maintaining the security of your account credentials. You must provide accurate information when creating an account. You may not create accounts for others without their consent or create multiple accounts to circumvent tier limits.

5. User Content

You retain ownership of all recipes, images, and other content you create on Yummoria. By publishing recipes publicly, you grant Yummoria and other users a non-exclusive, royalty-free licence to display, share, and interact with that content within the platform. You may revoke this licence at any time by making your recipe private or deleting it.

7. Premium Subscriptions & Billing

7.1 Pricing and Payment

Yummoria Premium is available as a monthly or yearly subscription. Polish customers can pay 14.99 PLN/month or 119.00 PLN/year. Where EUR regional pricing is available, customers can pay €3.49/month or €27.99/year. All prices include applicable VAT. Payments are processed securely by Stripe.

7.2 Automatic Renewal

Subscriptions renew automatically at the end of each billing period (monthly or yearly) unless you cancel before the renewal date. You will be charged the current subscription price at the time of renewal. Stripe will attempt to charge your saved payment method on the renewal date.

You may cancel your subscription at any time through the billing portal accessible from your Account settings. Upon cancellation:

If a payment fails, Stripe will retry the charge according to its retry schedule. During this period, your subscription status becomes "past due" but you retain Premium access. If all retry attempts fail, your subscription is cancelled and your account reverts to the Free tier.

8. Right of Withdrawal (EU Consumers)

Under the EU Consumer Rights Directive (2011/83/EU), you have the right to withdraw from a distance contract within 14 days of purchase without giving any reason.

However, by proceeding with checkout and gaining immediate access to Yummoria Premium, you expressly consent to the immediate provision of digital content and acknowledge that you thereby waive your 14-day right of withdrawal. This consent is collected during the checkout process.

If you have not yet accessed the Premium features after subscribing, you may request a full refund within 14 days by contacting us at legal@yummoria.com.

9. Refund Policy

Due to the immediate-access nature of digital subscriptions, refunds are generally not available once the withdrawal right has been waived (see Section 8). Exceptions may apply where required by applicable consumer protection law. If you believe you are entitled to a refund, please contact us at legal@yummoria.com.

10. Service Availability

We strive to keep Yummoria available at all times but do not guarantee uninterrupted service. We may perform scheduled maintenance with reasonable notice. We are not liable for temporary unavailability caused by circumstances beyond our control.

11. Limitation of Liability

To the maximum extent permitted by applicable law:

Nothing in these terms limits our liability for fraud, gross negligence, death or personal injury caused by our negligence, or any liability that cannot be excluded by law.

12. Data and Privacy

We process your personal data in accordance with our Privacy Policy and applicable data protection laws including the GDPR. You have the right to access, export, rectify, and delete your personal data at any time through your account settings or by contacting us.

13. Changes to These Terms

We may update these terms from time to time. If we make material changes, we will notify you by email or through the app at least 30 days before the changes take effect. If you disagree with the new terms, you may cancel your subscription and close your account before they take effect. Continued use of the service after the effective date constitutes acceptance of the updated terms.

If you have a dispute with us, we encourage you to contact us first at legal@yummoria.com to attempt an amicable resolution.

As an EU consumer, you may also use the European Commission's Online Dispute Resolution (ODR) platform: https://ec.europa.eu/consumers/odr/

15. Governing Law

These terms are governed by the laws of Poland. If you are a consumer residing in the EU, you also benefit from any mandatory provisions of the consumer protection laws of your country of residence. Any disputes shall be subject to the jurisdiction of the courts of Poland, without prejudice to your right as an EU consumer to bring proceedings in the courts of your country of residence.

16. Severability

If any provision of these terms is found to be unenforceable, the remaining provisions remain in full force and effect.
